Altair is seeking a Senior Non-Key Expert in the area of IPARD to provide assistance in ensuring adequate legal basis for intra-institutional cooperation between MA and IPARD Agency in frame of implementation of TA measure, financed by IPARD II Programme as well as to improve established monitoring system in view of reduction of de-commitment risk.

The requested services are:

  1. To prepare / modify Agreement on Implementation of Technical Assistance Measure under IPARD II Programme for the period 2014-2020 of the Republic of Serbia between MA and IPARD Agency (in continuation of the text: Agreement) according to the findings of EC audit mission (non-exhaustive list of audit recommendations):
  • Provisions in the Agreement should be in line with consolidated versions of procedures of both entities MA and IPARD Agency (for instance article 17 of the IPARD Contract/Decision);
  • Article 6 on the fixed costs should be re-phrased in line with auditor’s comment for the IPARD Agency;
  • Concerning Article 12, it should be noted that the lack of availability of funds is not a valid reason for ''Rejection of an application";
  • Article 14 should be re-phrased: in case a bidder asks clarifications to the Contracting Authority, the IPARD Agency may be consulted before providing the reply, but segregation of roles during the tender process has to be ensured;
  • Article 21(8) concerning the OTSC should be aligned with finding related to the OTSC for the IPARD Agency, as also in case of international events on-the-spot controls should be carried out, at least on a sampling basis;
  • The role of the Complaint Committee should be further detailed including how this committee should be formed, what is the deadline to reply to the respective complaints, etc.;
  • A provision on the interest to be calculated for those debts, which are not reimbursed by the MA in due time should be included;
  • Development of procedure for the contracting phase (MoU (after application approval) and IPARD Contract (after tender procedurehas been conducted));
  • To include in procedures of IPARD Agency key control over the tender dossier once the PRAG procurement was finalised;
  • To provide proper segregation of tasks between MA and IPARD Agency during the tender process;
  • The procedure of IPARD Agency should be amended, in order to reflect the steps of the general workflow for implementing TA once it has been designed;
  • The checklist used to control the completeness and eligibility of the application should include also a control over the non-discriminatory nature of the Terms of Reference and technical specifications;
  • The control procedures should be adapted to the list of eligible expenditure (LEE);
  1. To design general workflow for implementing TA concerning the steps carried out by MA and IPARD Agency, and within internal organizational units of MA and IPARD Agency;
  2. To deliver training to the staff of MA and IPARD Agency and other relevant staff involved in implementation of TA measure.

Total working days: 26 working days (WDs) in total have been planned for this assignment, of which 13 WDs for Senior NKE and 13 WDs for Junior NKE. Additional number of WDs may be allocated for this ToR, should the needs of target beneficiaries require an extension for the activity areas mentioned in this ToR.

Period of the assignment: November 2016 – (tentatively) December 2016. Two NKEs shall work in parallel. Details regarding the most relevant timing of their missions shall be agreed at a later stage. 

Starting day: It is expected that the work will be performed during up to two missions in the period from November 2016 until tentatively, December 2016 and starting, at the earliest, from 21 November 2016 onwards. However, exact starting date will be agreed at a later stage.

Location/Place of assignment: The NKEs have to deliver 100% of the input in Belgrade, Serbia.

Expert Profile:

Qualifications and skills

  • An university degree (where an university degree has been awarded on completion of three years study in an university or equivalent institution)in Natural Sciences, Law or other, relevant to the assignment
  • Proficiency in English language
  • Computer literacy (MS Office applications)

General professional experience

  • Minimum 10 years of postgraduate professional experience in the field of Agriculture and Rural Development

Specific professional experience

  • Proven professional experience in establishing systems or implementation or audit of EU funded IPARD Measures, preferably TA measure and PRAG rules, gained in an EU member state, candidate or potential candidate country
  • Previous professional experience, and/or knowledge of the legislation, of the Republic of Serbia in the respective area would be an advantage
